Full text of China’s Civil Code (Draft) Unveiled

24日，十三届全国人大常委会第十五次会议分组审议民法典草案。

民法典（草案）共7编，依次为总则编、物权编、合同编、人格权编、婚姻家庭编、继承编、侵权责任编，以及附则，共1260条。

With a total of 1,260 articles, the Civil Code (Draft) consists of such seven parts as the General Provisions Part, Property Part, Contracts Part, Personality Rights Part, Marriage and Family Part, Inheritance Part, Torts Part and Supplementary Provisions. 

侵权责任编完善了高空抛物坠物责任规则，明确物业要尽安全责任。合同编规定禁止高利放贷，借款的利率不得违反国家有关规定。人格权编完善禁止性骚扰条款，明确“机关、企业、学校等”的防止性骚扰责任。婚姻家庭编草案规定一方患有重大疾病的，应当在结婚登记前如实告知另一方；不如实告知的，另一方可以向人民法院请求撤销婚姻。

此外，草案还对离婚冷静期、近亲属范围等作出规定。

2. 证券法草案四审

12月23日,证券法草案提请十三届全国人大常委会第十五次会议第四次审议。　

《草案》主要内容包括：一、全面推行注册制，不再规定核准制，取消发审委制度。二、精简优化证券发行条件。将发行股票应当“具有持续盈利能力”的要求，改为“具有持续经营能力”。三、明确国务院统一规定资产支持证券、资管产品管理办法。四、明确证券法必要的域外适用效力。在中华人民共和国境外的证券发行和交易活动，扰乱中华人民共和国境内市场秩序，损害境内投资者合法权益的，依照本法有关规定处理并追究法律责任。五、明确投资者保护机构可提起代表人诉讼。六、将违法处罚标准提高到一至十倍，欺诈发行顶格罚2000万。

3. 社区矫正法草案三审

Community Correction Law (Draft) Submitted to the NPC Standing Committee for Third Deliberation

On December 23, 2019, the Community Correction Law (Draft) was submitted to the 15th Session of the Standing Committee of the Thirteenth National People's Congress for the third deliberation.

The Draft stipulates that the time limit within which the means of electronic positioning can be used should not exceed three months. Where the means no longer needs using, it should be lifted in time; and when time limit expires, where the method still needs using upon assessment, the period can be extended after being approved, but it should not exceed three months each time. The Draft also adds two circumstances under which the electronic positioning may be used: where a person is given a warning for his or her refusal to report their activities in accordance with relevant provisions; and where a proposal is raised for revoking probation or parole, or putting the person who is temporarily serving his or her sentence outside prison behind bars.

4. 多部法律草案提请全国人大常委会会议审议

Several Bills Submitted to the NPC Standing Committee for Deliberation

The 15th Session of the Standing Committee of the Thirteenth National People's Congress was held in Beijing on December 23, 2019, and several bills are deliberated at this Session.

The Law on the Protection of the Yangtze River (Draft) is submitted for the first deliberation, and it is proposed that the State Council should establish a coordination mechanism for the basins.

The Law on the Promotion of Basic Medical and Health Care (Draft) for the fourth deliberation adds that public places should be equipped with necessary first-aid equipment and facilities in accordance with relevant provisions.

The Law on the Prevention and Control of Environmental Pollution Caused by Solid Wastes (Revised Draft) for the second deliberation adds that the tourism, catering business and other industries should gradually become less and less active in providing disposable items, and the use of disposable office products should be reduced in offices.

The Forest Law (Revised Draft) for the third deliberation specifies the scope of functions of forest public security authorities.

In addition, the Law on City Maintenance and Construction Tax (Draft), the Deed Tax Law (Draft) and the Law on Export Control (Draft) are all submitted for the first deliberation.
